Terms of Service
Website Terms of Service
Kachug LLC · Kachug Home Services
Effective date: June 1, 2026. Please read carefully before using this Website.
What these Terms cover. By accessing or using kachug.com (the "Site"), you agree to: (1) use the Site only for lawful purposes and in accordance with these Terms; (2) the Privacy Policy and cookie disclosures referenced herein; (3) the disclaimers and limitations of liability set forth in Sections 10 and 11; and (4) the dispute resolution provisions in Section 13.
These Terms govern your use of the Website itself. Booking and receiving a Residential Infrastructure Assessment is governed by a separate Service Agreement which you will accept at the time of booking; the Service Agreement controls the booking-and-assessment relationship. These Terms are not a home inspection contract and do not constitute professional advice.
1. Definitions
As used in these Terms, the following terms have the meanings set forth below. Capitalized terms not defined here have the meanings given to them in the Service Agreement.
"Booking Commitment" means your submission of the booking form on the Site, including your acceptance of the Service Agreement at the time of submission, indicating your intent to schedule an Assessment.
"Content" means all text, graphics, images, photographs, video, audio, sample reports, downloadable documents, and other materials made available on or through the Site, whether owned by Kachug or licensed from third parties.
"Customer Portal" means the separate Kachug customer portal accessible at portal subdomains of kachug.com, which delivers Assessment reports and processes payment after Assessment completion. The Customer Portal is governed by its own terms once you authenticate.
"Kachug" means Kachug LLC, a Georgia limited liability company doing business as Kachug Home Services, and its officers, employees, agents, and contractors.
"Privacy Policy" means the Kachug Home Services Privacy Policy published at kachug.com/privacy-policy, which describes how Kachug collects, uses, and discloses personal information.
"Service Agreement" means the Residential Infrastructure Assessment Service Agreement between Kachug and you, accepted at the time of Booking Commitment, which governs the booking, scheduling, performance, payment, and delivery of an Assessment.
"Site" means the website operated by Kachug at kachug.com, including all pages, subdomains controlled by Kachug for marketing and information purposes (excluding the Customer Portal), and Content made available thereon.
"User, you, your" means any person who accesses or uses the Site, including visitors, prospective customers, partners, and other parties.
2. Acceptance of Terms; Modifications; Conflicts
(a) Acceptance. By accessing or using the Site in any way, you agree to be bound by these Terms and by the Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Site.
(b) Modifications. Kachug reserves the right to update or modify these Terms at any time and in its sole discretion. The version of these Terms in effect at the time you access the Site governs your use of the Site at that time. Material changes will be posted on the Site, and continued use of the Site following such posting constitutes acceptance of the modified Terms. Kachug recommends that you review these Terms periodically.
(c) Relationship to the Service Agreement. These Terms govern your use of the Site only. The Service Agreement governs the booking, scheduling, performance, payment, and delivery of any Assessment. In the event of any conflict between these Terms and the Service Agreement with respect to the booking-and-assessment relationship, the Service Agreement controls. In the event of any conflict between these Terms and the Privacy Policy with respect to the collection, use, or disclosure of personal information, the Privacy Policy controls.
3. Eligibility
(a) Age Requirement. You must be at least eighteen (18) years of age to use the Site or to submit a Booking Commitment. By using the Site, you represent and warrant that you are at least eighteen (18) years of age and have the legal capacity to enter into a binding agreement.
(b) Geographic Availability. Kachug currently offers its services in defined geographic service areas in the State of Georgia, with planned expansion to additional geographies. The Site is intended for users in the United States. By using the Site, you represent and warrant that you are accessing the Site from a jurisdiction in which such use is lawful.
(c) Authorization to Act. If you submit a Booking Commitment on behalf of another person or entity, you represent and warrant that you have the legal authority to do so. If you submit any partner, professional, or organizational inquiry through the Site, you represent and warrant that you have the authority to bind the organization on whose behalf you are inquiring.
4. Description of the Site
(a) Marketing and Information Surface. The Site is the public marketing and information surface for Kachug Home Services and the Residential Infrastructure Assessment. It allows visitors to learn about the service, review pricing, view sample report excerpts (linked from the Customer Portal), submit Contact and partner inquiries, and submit Booking Commitments.
(b) Booking Commitment Only. A Booking Commitment submitted through the Site indicates your intent to schedule an Assessment and your acceptance of the Service Agreement. The Site does not collect payment for any Assessment. Payment is collected through the Customer Portal after the Assessment has been completed, in accordance with the Service Agreement.
(c) Scheduling Not Guaranteed at Submission. Submission of a Booking Commitment does not guarantee a specific date or time for the Assessment. Kachug operations will contact you to confirm scheduling within the response window stated on the booking confirmation page. Kachug reserves the right to decline or reschedule any requested Assessment for reasons including but not limited to capacity, geographic constraints, or property conditions.
(d) Service Area Limitations. Kachug currently offers Assessments only within defined service areas. If your property is outside the current service area, Kachug operations will inform you and may, at its discretion, offer to add your address to a waitlist for future expansion or recommend other resources. Kachug shall have no liability for inability to perform an Assessment.
(e) No Representation of Continuous Availability. Kachug does not represent or warrant that the Site will be available at all times, free from errors, or accessible from all locations or devices. Kachug may suspend or modify the Site, in whole or in part, at any time and without notice.
5. Acceptable Use; Prohibited Conduct
(a) Permitted Use. You may access and use the Site solely for the purpose of learning about and engaging Kachug's services in accordance with these Terms and applicable law.
(b) Prohibited Conduct. You agree that you will not, and will not permit any third party to:
- use the Site for any unlawful purpose or in violation of any applicable law, regulation, or these Terms;
- submit false, misleading, or inaccurate information through any form on the Site, including the booking, Contact, or partner forms;

- fabricate, manipulate, or misuse partner-attribution tags or referral URLs to obtain referral credit, attention, or compensation to which you are not entitled;
- reverse engineer, decompile, scrape, harvest, crawl (other than as a properly identified, robots.txt-compliant search engine crawler), or otherwise programmatically extract Content from the Site without express written permission from Kachug;

(c) Termination of Access for Violation. Kachug may suspend, restrict, or terminate your access to the Site at any time, with or without notice, for any conduct Kachug believes, in its sole discretion, violates these Terms or applicable law, or that is otherwise harmful to other users, to Kachug, or to third parties.
6. Intellectual Property
(a) Kachug Ownership. All Content on the Site, including the design, layout, text, graphics, photographs, illustrations, logos, trademarks, service marks, trade names, trade dress, video, audio, software, and underlying source code, is owned by Kachug or its licensors and is protected by copyright, trademark, trade dress, and other intellectual property laws of the United States and other jurisdictions. "Kachug" and "Kachug Home Services" are trademarks of Kachug LLC.
(b) Limited License to Use the Site. Subject to your compliance with these Terms, Kachug grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site and to view Content for your personal, non-commercial purposes. No other rights or licenses are granted by these Terms, whether by implication, estoppel, or otherwise.
(c) Restrictions. You may not copy, reproduce, distribute, publish, modify, translate, adapt, create derivative works of, publicly display, publicly perform, sell, license, sublicense, or otherwise exploit any Content, in whole or in part, except as expressly authorized in these Terms or with Kachug's prior written consent. You may not remove or alter any copyright, trademark, or other proprietary notice on or in any Content.
(d) Copyright Infringement Notices (DMCA). Kachug respects the intellectual property rights of others. If you believe that Content available on the Site infringes your copyright, please send a written notice containing the information required by 17 U.S.C. § 512(c)(3) to Kachug's designated agent at the contact information in Section 17. Kachug will respond to properly submitted notices in accordance with the Digital Millennium Copyright Act.
(e) User-Submitted Content License. If you submit any text, image, suggestion, feedback, or other content through the Site (other than personal information governed by the Privacy Policy and information governed by the Service Agreement), you grant Kachug a perpetual, irrevocable, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, publish, display, and distribute such content for any lawful business purpose, including service improvement and marketing, in anonymized or aggregated form. You represent and warrant that you have all rights necessary to grant this license.
7. User Submissions and Information
(a) Forms and Inquiries. The Site provides forms through which you may submit a Booking Commitment, a Contact inquiry, a partner or referral-professional inquiry, or other communications. You agree that any information you submit will be true, accurate, current, and complete to the best of your knowledge, and that you will promptly correct any inaccuracies.
(b) No Sensitive Data Beyond What Is Requested. You agree not to submit any sensitive personal information through the Site beyond what is expressly requested by a form. The Site does not collect government identification numbers, financial account numbers, or other categories of sensitive personal information; do not submit such information through the Site.
(c) Booking-Form Submissions. Information submitted through the booking form is delivered to Kachug operations and used to schedule and perform the Assessment in accordance with the Service Agreement. The Service Agreement, not these Terms, governs Kachug's collection, use, and retention of booking-related information.
(d) Contact and Partner Submissions. Information submitted through the Contact form or the partner inquiry form is used by Kachug to respond to your inquiry. Kachug's response time commitment, if any, is stated on the relevant page of the Site at the time of submission.
8. Third-Party Services, Links, and Contractors
(a) Customer Portal. The Site may link to the Customer Portal, including to a sample report excerpt hosted on the Customer Portal. The Customer Portal is operated by Kachug under separate terms. Once you leave the Site and access the Customer Portal, the terms applicable to the Customer Portal govern your use of that portal.
(b) Payment Processing. Kachug uses Stripe, Inc. as its payment processor for Assessment fees. All payment processing is performed by Stripe through the Customer Portal, not through this Site. Stripe's terms of service, privacy policy, and other applicable terms govern your relationship with Stripe.
(c) Analytics, Advertising, and Other Third-Party Services. The Site uses third-party services for analytics, advertising-pixel tracking, session analytics, and search functionality, including services provided by Google LLC, Meta Platforms, Inc., and Microsoft Corporation. The Privacy Policy describes these services and the choices available to you.
(d) Partner Contractors and Referral Professionals. The Site may identify, link to, or otherwise reference real estate professionals, home inspectors, trade contractors, or other partners. Kachug does not endorse, insure, supervise, recommend, or guarantee any such third party or the services they provide. The Service Agreement governs the distribution of Leads to Partner Contractors. You are solely responsible for evaluating and selecting any third party with whom you choose to engage.
(e) External Sites. The Site may contain links to websites or resources operated by third parties. Kachug does not control such third-party sites and is not responsible for their content, privacy practices, or availability. Inclusion of a link on the Site does not constitute Kachug's endorsement of the linked site.
9. Privacy and Cookies
(a) Privacy Policy. The Privacy Policy describes how Kachug collects, uses, discloses, and protects personal information collected through the Site. The Privacy Policy is incorporated into these Terms by reference. By using the Site, you acknowledge that you have read the Privacy Policy.
(b) Cookies and Analytics Technologies. The Site uses cookies, pixels, session-recording technologies, and similar tracking technologies as described in the Privacy Policy and on the Site's cookie consent interface. By using the Site, you acknowledge the cookie disclosures and may exercise the choices made available through the cookie consent interface.
(c) Service Agreement Governs Crawlspace and Assessment Data. Crawlspace data, photographs, video, sensor readings, and other data captured during an Assessment are governed by the Service Agreement, including its data retention, deletion, and security provisions, and are not within the scope of the Site's data handling described in these Terms or the Privacy Policy.
10. Disclaimers
(a) DISCLAIMER OF WARRANTIES. THE SITE, THE CONTENT, AND ANY FORMS, FEATURES, OR FUNCTIONALITY MADE AVAILABLE THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE." KACHUG MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, CURRENCY, OR THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
(b) NO PROFESSIONAL ADVICE. CONTENT ON THE SITE IS PROVIDED FOR GENERAL INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE PROFESSIONAL ADVICE OF ANY KIND. THE SITE DOES NOT PROVIDE A HOME INSPECTION, ENGINEERING OPINION, CODE COMPLIANCE DETERMINATION, ENVIRONMENTAL ASSESSMENT, REAL-ESTATE ADVICE, LEGAL ADVICE, FINANCIAL ADVICE, OR INSURANCE ADVICE. YOU SHOULD NOT RELY ON ANY CONTENT ON THE SITE AS A SUBSTITUTE FOR PROFESSIONAL ADVICE FROM A QUALIFIED PROFESSIONAL IN THE APPLICABLE FIELD.
(c) NOT A HOME INSPECTION. THE INFORMATION AVAILABLE ON THE SITE IS NOT A HOME INSPECTION AS DEFINED BY GEORGIA LAW (O.C.G.A. § 43-41-1 ET SEQ.) AND IS NOT PERFORMED BY A LICENSED HOME INSPECTOR. ANY ASSESSMENT SUBSEQUENTLY PERFORMED UNDER THE SERVICE AGREEMENT IS ALSO NOT A HOME INSPECTION AS DEFINED BY GEORGIA LAW; THE DISCLAIMERS IN THE SERVICE AGREEMENT APPLY TO THE ASSESSMENT ITSELF.
(d) NO GUARANTEE OF SERVICE OUTCOMES. KACHUG MAKES NO GUARANTEE, REPRESENTATION, OR WARRANTY REGARDING THE OUTCOME OF ANY ASSESSMENT, THE FINDINGS THAT MAY OR MAY NOT BE IDENTIFIED DURING AN ASSESSMENT, THE RESPONSE OR CONDUCT OF ANY PARTNER CONTRACTOR OR OTHER THIRD PARTY, OR ANY OTHER OUTCOME RELATED TO YOUR USE OF THE SITE OR ANY SUBSEQUENT SERVICE.
11. Limitation of Liability
(a) LIABILITY CAP. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KACHUG'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING UNDER OR RELATED TO YOUR USE OF THE SITE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00). THE GREATER LIABILITY CAP SET FORTH IN THE SERVICE AGREEMENT APPLIES ONLY TO CLAIMS ARISING UNDER OR RELATED TO THE SERVICE AGREEMENT AND A PERFORMED OR ATTEMPTED ASSESSMENT.
(b) EXCLUSION OF INDIRECT DAMAGES. IN NO EVENT SHALL KACHUG BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST BUSINESS OPPORTUNITY, LOSS OF DATA, LOSS OF GOODWILL, OR COST OF SUBSTITUTE SERVICES, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY AND REGARDLESS OF WHETHER KACHUG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
(c) NO LIABILITY FOR THIRD-PARTY CONDUCT. KACHUG SHALL HAVE NO LIABILITY FOR THE ACTS, OMISSIONS, SERVICES, OR WORK PERFORMED BY ANY PARTNER CONTRACTOR, REAL-ESTATE OR INSPECTION PROFESSIONAL, PAYMENT PROCESSOR, ANALYTICS PROVIDER, OR OTHER THIRD PARTY REFERENCED ON OR LINKED FROM THE SITE.
(d) JURISDICTIONAL LIMITATIONS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES. TO THE EXTENT ANY SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW, KACHUG'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY SUCH LAW.
12. Indemnification
(a) Indemnification by You. You agree to indemnify, defend, and hold harmless Kachug and its officers, employees, agents, contractors, licensors, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees and court costs, arising from or related to: (i) your use of the Site; (ii) your breach of any representation, warranty, or obligation under these Terms; (iii) your violation of any applicable law or any third-party right, including intellectual property, privacy, or publicity rights; (iv) any false, misleading, or unauthorized information you submit through the Site; or (v) your misuse of any partner-attribution tag or referral URL.
(b) Procedure. Kachug shall have the right, but not the obligation, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Kachug in asserting any available defenses. You may not settle any matter without Kachug's prior written consent.
13. Governing Law and Dispute Resolution
(a) Governing Law. These Terms shall be governed by and construed under the laws of the State of Georgia, without regard to its conflict of laws principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts in Cobb County, Georgia.
(b) Dispute Resolution. The parties agree to make a good-faith effort to resolve any dispute informally before commencing legal proceedings. In the event that a dispute cannot be resolved through such good faith efforts within thirty (30) days of the date the dispute arises, either party may submit such disputes to arbitration before a single arbitrator in Cobb County, Georgia pursuant to the rules of the American Arbitration Association. Nothing herein shall be construed as a waiver by either Party of the right to pursue any available legal recourse.
(c) Relationship to Service Agreement Disputes. Disputes arising under or related to the Service Agreement and any performed or attempted Assessment are governed by the dispute resolution provisions of the Service Agreement. The dispute resolution provisions of these Terms govern only disputes arising from your use of the Site itself.
14. Termination
(a) Termination of Site Access by Kachug. Kachug may suspend, restrict, or terminate your access to the Site at any time, with or without notice and with or without cause. Kachug shall have no liability to you for any such suspension, restriction, or termination.
(b) Termination of Use by You. You may stop using the Site at any time. Termination of your use does not affect any Service Agreement you have already accepted; the Service Agreement continues to govern any associated Booking Commitment and Assessment in accordance with its own terms.
(c) Survival. The following provisions of these Terms survive any termination or expiration: Section 1 (Definitions), Section 6 (Intellectual Property), Section 7 (User Submissions and Information), Section 10 (Disclaimers), Section 11 (Limitation of Liability), Section 12 (Indemnification), Section 13 (Governing Law and Dispute Resolution), Section 14(c) (Survival), Section 16 (General Provisions), and any other provision that by its nature is intended to survive.
15. State-Specific Addenda
As Kachug expands its service area beyond the State of Georgia, additional state- and jurisdiction-specific provisions may become applicable to your use of the Site.
16. General Provisions
(a) Entire Agreement. These Terms, together with the Privacy Policy and any specific terms applicable to particular features or services made available on the Site, constitute the entire agreement between you and Kachug with respect to your use of the Site, and supersede any prior representations or understandings with respect to the same subject matter. The Service Agreement, when accepted, constitutes a separate and additional agreement governing the booking-and-assessment relationship.
(b) Force Majeure. Kachug shall not be liable for delays or failure due to events beyond its reasonable control, including but not limited to acts of God, weather, natural disasters, fires, equipment failure, internet or telecommunications outages, governmental action, civil unrest, labor disputes, or pandemics.
(c) Independent Contractor. The parties are at all times acting as independent contractors. Nothing in these Terms shall be construed to create a partnership, joint venture, employment, or agency relationship between the parties.
(d) Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to render it valid and enforceable.
(e) Waiver. Failure by Kachug to enforce any provision of these Terms shall not constitute a waiver of its right to enforce such provision in the future. Any waiver must be in writing and signed by an authorized representative of Kachug to be effective.
(f) Assignment. Kachug may assign these Terms, in whole or in part, without your consent, including as part of a business combination, asset sale, or corporate reorganization. You may not assign these Terms or any rights or obligations hereunder without Kachug's prior written consent. Any purported assignment in violation of this Section is void.
(g) Notices. Kachug may provide notices to you by posting on the Site, by email to the address you have provided, or by other reasonable means. You may provide notices to Kachug as set forth in Section 17.
(h) Headings. Section and subsection headings in these Terms are for convenience only and do not affect the interpretation of any provision.
(i) No Third-Party Beneficiaries. These Terms are for the benefit of you and Kachug only, and no third party shall have any right to enforce any provision of these Terms.
